EASA Open Category A1

Our DJI Neo 2 weighs less than 250 grams, placing it in the EASA Open Category A1. This category allows operation with the fewest restrictions:

• No remote ID required for sub-250g drones in A1
• Permitted in many areas where heavier drones are restricted
• Minimum age: 16 years (or 12 with adult supervision)
• Operator registration required with the national aviation authority

A1/A3 Pilot Certification

Our operator holds the EU Drone Pilot Certificate (A1/A3), obtained through the official EASA online training and exam. This certification covers:

• Airspace regulations and restrictions
• Drone safety procedures
• Emergency situations and risk management
• Privacy and data protection rules

Luxembourg Drone Regulations

Operating in Luxembourg requires compliance with national regulations in addition to EASA rules:

• Max altitude: 120 metres (400 feet) above ground level
• Visual line of sight: The drone must remain visible to the operator at all times
• No-fly zones: Airports, military installations, nuclear facilities, and other restricted areas are strictly avoided
• Night operations: Permitted with appropriate lighting and precautions
• Over people: A1 category allows limited overflight of uninvolved persons

GDPR Compliance

Aerial photography may capture images of private property and individuals. Emperor Penguin Development adheres to GDPR (General Data Protection Regulation) requirements:

• Data minimisation - we collect only what is necessary
• Purpose limitation - images are used only for the agreed purpose
• Storage limitation - raw footage is deleted after project completion unless otherwise agreed
• Right to erasure - individuals can request removal of identifying images

Insurance

Emperor Penguin Development maintains EU-mandated drone liability insurance coverage, as required by EU Regulation 2019/947. This ensures protection in the unlikely event of an incident.
